Cirrus Logic Claims Wolfson Microelectronics Infringes on Patents

10/16/2003 - Cirrus Logic Inc. (Nasdaq: CRUS) announced that it has filed a Complaint with the U.S. International Trade Commission (ITC) in Washington, D.C., requesting that the ITC initiate an investigation of Wolfson Microelectronics, plc, a United Kingdom company, for violation of Section 337 of the Tariff Act of 1930, as amended, in the importation, sale for importation and sale in the United States after importation of certain digital-to-analog converters and other products containing such converters.

The ITC is being asked to investigate whether certain Wolfson products infringe one or more of the claims of U.S. Patent No. 6,492,928. Cirrus Logic confirms that it is the exclusive owner of the patent and asserts, based on its investigation and analysis, that the following Wolfson products are infringing: WM8706, WM8716, WM8718, WM8719, WM8726, WM8727, WM8728, WM8729, WM8740, WM8746, WM8756, WM8759, WM8761, WM8762 and WM8772. These same products are the subject of a federal district court lawsuit filed by Cirrus Logic last week in the U.S. District Court for the Southern District of California.

If the ITC supports Cirrus Logic's claim, the ITC could issue a permanent exclusion order banning the importation into the United States of the alleged infringing products and a cease-and-desist order halting the sale of such infringing products, as well as such other and further relief the ITC deems proper.
